These Terms of Use ("Terms") govern your use of the Pot Glondach iPhone application and the Pot Glondach Mac application (together "the Apps") published by Rafał Piekara ("we", "us", "the developer"). By downloading, installing, or using the Apps, you agree to be bound by these Terms. If you do not agree, do not use the Apps.
If you have questions about these Terms, contact us at rafal@piekara.me.
1. The Apps
Pot Glondach shows the live view of your iPhone camera in a window on your Mac while you record on the iPhone. The iPhone app is available through the Apple App Store. The Mac app is downloaded from piekara.me. Both apps are free.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Apps on devices you own or control, for your own use. You may not copy, modify, distribute, sell, or lease any part of the Apps, reverse engineer or attempt to extract their source code, or use them in any unlawful way.
3. Your responsibilities
You are responsible for what you record and broadcast. The iPhone app shows whatever is on your iPhone screen while a broadcast is running; make sure you have the right to capture it and to show it to anyone who can see your Mac screen. Only pair devices you own or are permitted to use, and keep your pairing code private.
4. Privacy
The Apps send your camera preview directly between your own devices and do not store or upload it. How the Apps handle information is described in the Privacy Policy at piekara.me/apps/pot-glondach/privacy-policy.
5. Intellectual property
The Apps, including their design, code, name, and icon, are owned by Rafał Piekara and protected by copyright and other laws. These Terms do not grant you any rights to our trademarks or other intellectual property beyond the license in section 2.
6. Updates
The Mac app may check for and install updates from piekara.me. The iPhone app is updated through the App Store. We may change, suspend, or discontinue the Apps or any feature at any time without liability to you.
7. Disclaimers
The Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Preview quality and delay depend on your devices and your network, and a preview may stop or fall behind during a recording. The Apps are not a replacement for checking the recording on the iPhone itself.
8. Limitation of liability
To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost recordings, profits, data, or use, arising out of or relating to your use of the Apps.
For users in the European Union, nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.
9. Apple's role
You acknowledge that these Terms are entered into between you and Rafał Piekara, not Apple, and that Apple has no responsibility for the Apps or their content. Apple is, however, a third-party beneficiary of these Terms with respect to the iPhone app and may enforce them against you. The full text of Apple's standard end-user license terms applicable to apps distributed through the App Store is available at: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with Apple's standard terms, the more restrictive provision applies, except where prohibited by law.
10. Changes to these Terms
We may update these Terms from time to time. The current version is always available at the address below. Material changes will be noted in the App Store description or the Mac app's release notes. Your continued use of the Apps after a change indicates acceptance of the revised Terms.
11. Termination
We may suspend or terminate your right to use the Apps at any time if you breach these Terms. You may stop using the Apps at any time by deleting them from your devices. Sections 5 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), and 12 (Governing Law) survive termination.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the Polish courts, except where mandatory consumer protection rules grant you the right to bring proceedings in the courts of your country of residence.
For users in the European Union: you may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
