Five Wins Terms of Use

These Terms of Use ("Terms") govern your use of the Five Wins mobile application ("the App") published by Rafał Piekara ("we", "us", "the developer"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. The App

Five Wins is a nightly-ritual journaling app. At a chosen evening hour, you record five wins from your day — by voice or typed — and seal them. Over time, the practice accrues into a personal archive of timelines, mantras, and a year-in-review. The App is available on iPhone through the Apple App Store.

The App is provided by Rafał Piekara, a sole proprietor based in Poland.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal, non-commercial use.

You may not:

• Reverse engineer, decompile, or disassemble the App except to the extent permitted by applicable law.
• Sell, sublicense, lease, rent, or distribute the App or any part of it.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
• Use the App in any way that violates applicable law.

3. Subscription

The App offers an auto-renewable in-app subscription that unlocks the full practice — the nightly ritual, history, mantras, widgets, and year-in-review.

3.1 Plans, length, and price

Prices in other storefronts are set automatically by Apple and shown in your local currency at the point of purchase. The price displayed in the App at the time of purchase is authoritative.

3.2 Payment

Payment is charged to your Apple ID account at confirmation of purchase. All payments are processed by Apple, not by the developer. The developer never receives or stores your payment card details.

3.3 Auto-renewal

Your subscription automatically renews at the end of each billing period (monthly or annually) at the price published in the App Store at the time of renewal, unless you cancel auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

3.4 Free trial

Each plan begins with a 3-day free trial. If you cancel during the trial, you will not be charged. If you do not cancel before the trial ends, the subscription will start automatically and the standard price will be charged. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

3.5 Managing and cancelling

You can manage and cancel your subscription at any time from your iOS device:

Cancellation takes effect at the end of the current paid period. You retain access to the paid features until that date.

3.6 Refunds

Refund requests are handled by Apple under Apple's terms. We cannot directly refund a subscription. To request a refund, visit reportaproblem.apple.com.

By law, residents of the European Union and similar jurisdictions have the right to withdraw from a digital purchase within 14 days. By starting to use the paid features (including starting the free trial), you expressly request immediate access and acknowledge that your right to withdraw lapses once the service has been fully provided. Refund decisions are nevertheless made by Apple in accordance with their policies.

4. Your content

The App does not require an account and does not store your entries on a server. Your wins are stored locally on your device. You may export or permanently wipe your data at any time from within the App. Because we hold no copy, deleting the App removes your entries unless you have exported them first.

5. Intellectual property

The App, including its name "Five Wins", logo, graphics, code, and content, is owned by Rafał Piekara and protected by copyright and trademark laws.

These Terms grant you no right to use any trademark, logo, or domain name without prior written permission.

6. Privacy

Your use of the App is also governed by our Privacy Policy:

The Privacy Policy explains what limited data is processed in connection with subscriptions and optional analytics, and how you can exercise your data protection rights.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. The App is a personal journaling tool and is not a medical, psychological, or therapeutic service.

8. Limitation of liability

To the maximum extent permitted by law, the developer is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or use, arising out of or relating to your use of the App.

For users in the European Union, nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be limited or excluded by law.

Where liability cannot be excluded, our total aggregate liability arising out of or in connection with these Terms is limited to the amounts you paid for the subscription in the 12 months preceding the event giving rise to the claim.

9. Apple's role

You acknowledge that these Terms are entered into between you and Rafał Piekara, not Apple, and that Apple has no responsibility for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. The full text of Apple's standard end-user license terms applicable to apps distributed through the App Store is available at: apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with Apple's standard terms, the more restrictive provision applies, except where prohibited by law.

10. Changes to these Terms

We may update these Terms from time to time. The "Last Updated" date at the top will reflect the latest revision. Material changes will be communicated through the App Store description of the next App update. Your continued use of the App after a change indicates acceptance of the revised Terms.

11. Termination

We may suspend or terminate your right to use the App at any time if you breach these Terms. You may stop using the App at any time by deleting it from your devices. Sections 5 (Intellectual Property), 7 (Disclaimers), 8 (Limitation of Liability), and 12 (Governing Law) survive termination.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Poland, without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the Polish courts, except where mandatory consumer protection rules grant you the right to bring proceedings in the courts of your country of residence.
